This Acceptable Use Policy ("AUP") is part of 3RD ApS' Terms and Conditions and governs acceptable and unacceptable use of 3RD's SaaS platform and related services (the "Services").
By using the Services, you agree to comply with this AUP. Violation of the AUP may result in suspension or termination of your access to the Services.
1. Purpose and Application
The purpose of this AUP is to:
- Protect the integrity and security of the Services
- Ensure compliance with applicable laws
- Protect 3RD's relationships with third-party providers, including AI/LLM providers
- Ensure a secure and reliable experience for all users
This AUP applies to all users of the Services, including administrators, employees and other authorized users.
2. Prohibited Use
You must not use the Services for or in connection with the following activities:
2.1 Illegal Content and Activities
- Activities that violate applicable laws in Denmark, the EU or other relevant jurisdictions
- Infringement of third-party intellectual property rights (copyright, trademarks, patents, trade secrets)
- Violation of privacy and data protection rights
- Illegal distribution of controlled materials or substances
- Trade in illegal goods or services
2.2 Harmful and Misleading Content
- Malware, viruses, ransomware, trojans or other malicious software
- Phishing, social engineering or fraudulent activities
- Spam, bulk email or unsolicited commercial communication
- Misleading, fraudulent or manipulative content
- Content impersonating another person or organization
2.3 Offensive and Discriminatory Content
- Hate speech or content inciting violence or discrimination
- Harassment, bullying or threats against persons or groups
- Pornography or sexually explicit material
- Content related to child abuse or exploitation
- Content promoting terrorism or extremist ideologies
2.4 Security Abuse
- Unauthorized access to or attempts to access the Services, other users' accounts or systems
- Circumventing security measures, authentication mechanisms or access controls
- Scanning, penetration testing or vulnerability scanning without prior written permission
- Distributed Denial of Service (DDoS) or other load attacks
- Attempts to disrupt, damage or compromise the integrity or availability of the Services
2.5 AI and LLM-Specific Abuse
- "Jailbreaking" or attempts to circumvent AI models' security filters and guardrails
- Prompt injection or other attack techniques against AI models
- Systematic extraction or reverse engineering of underlying AI models
- Using the Services to train competing AI models without permission
- Generating content that violates third-party providers' (OpenAI, Anthropic, Google) acceptable use policies
2.6 Resource Abuse
- Excessive or abusive use of system resources (CPU, memory, bandwidth) affecting other users
- Automated scraping or data mining without permission
- Using the Services in a way that circumvents plan limitations or fair use policies
- Reselling or distributing the Services without written permission (unless part of your subscription)
2.7 Information Collection
- Collecting or attempting to collect personal information about other users without consent
- Harvesting email addresses or other contact information
- Unauthorized monitoring or tracking of users
3. Compliance with Third-Party Policies
The Services use third-party AI/LLM providers (including OpenAI, Anthropic and Google). You are required to comply with these providers' acceptable use policies:

3.2 Dynamic Compliance
3RD reserves the right to adjust functionality, implement filters or impose restrictions to ensure compliance with updated third-party policies without this constituting a breach by 3RD.
3.3 Impact on Third-Party Relationships
Use that may harm 3RD's relationships with third-party providers or result in suspension of 3RD's access to third-party services is strictly prohibited.
4. Fair Use and Resource Limitations
4.1 Fair Use Principle
The Services are designed for business use in accordance with your chosen subscription. Use must be:
- Reasonable and proportional to your subscription level
- In accordance with normal business practices
- Not designed to circumvent plan limitations
4.2 Rate Limits and Throttling
3RD may implement:
- Rate limits (limiting number of requests per hour/day)
- Throttling (speed limiting) during high load
- Queue systems to ensure fair resource distribution
- Automatic suspension for abnormal or suspicious activity
4.3 Exceeding Limits
If your use consistently exceeds reasonable limits, 3RD may:
- Contact you to discuss upgrading your subscription
- Temporarily limit your access
- Charge additional fees for overuse
- Suspend or terminate your account for persistent abuse
5. Reporting and Enforcement
5.1 Reporting Violations
If you become aware of violations of this AUP, please report it to:
abuse@get3rd.com
Please include:
- Description of the violation
- Relevant links, screenshots or documentation
- Date and time of the violation
- Any other relevant information
5.2 Investigation
3RD will:
- Investigate reported violations thoroughly and in confidence
- Cooperate with relevant authorities where necessary
- Protect the identity of reporting parties to the extent possible
5.3 Enforcement Measures
Upon violation of this AUP, 3RD may:
Minor Violations:
- Send a warning with request to remedy the situation
- Require removal of offending content
- Temporarily restrict access to specific features
Serious Violations:
- Immediately suspend access to the Services
- Terminate the agreement with immediate effect
- Deny data export in case of particularly serious violations (cf. Terms and Conditions, Section 13.3)
- Report the matter to relevant authorities
- Assert legal claims, including claims for damages
5.4 No Prior Notice
For serious violations that pose an immediate risk to security, legality or third-party relationships, 3RD may suspend or terminate access without prior notice.
6. Liability and Indemnification
6.1 Customer's Responsibility
The Customer is fully responsible for:
- All Users' activities and compliance with this AUP
- Configurations, prompts and Customer Content
- Use of Output from the Services
- Loss or damage caused by violation of AUP
6.2 Indemnification
The Customer shall indemnify 3RD for:
- Claims from third parties resulting from Customer's violation of AUP
- Fines or sanctions imposed on 3RD as a result of Customer's activities
- Loss of third-party licenses or relationships caused by Customer's abuse
- Legal costs associated with enforcement or defense
7. Changes to AUP
7.1 Right to Changes
3RD may update this AUP to reflect:
- Changes in legislation or regulation
- Updates to third-party providers' policies
- New security threats or best practices
- Improvements or changes to the Services
7.2 Notice
Material changes to the AUP are notified at least 30 days in advance via:
- Email to registered contact person
- Notification in the platform
- Update at https://trust.get3rd.com/aup
7.3 Continued Use
Continued use of the Services after changes take effect constitutes acceptance of the updated AUP.
7.4 Right to Termination
If you do not accept material changes, you may terminate your subscription with effect from the date the change takes effect.
8. Relation to Other Documents
This AUP is an integral part of:

In case of conflict between documents, the order set forth in the Terms and Conditions applies.
9. Legal Framework
9.1 Governing Law
This AUP is governed by Danish law.
9.2 Compliance
The Customer is responsible for ensuring that their use of the Services complies with:
- GDPR and data protection legislation
- EU AI Act
- Marketing laws
- Other relevant industry or jurisdiction-specific legislation
9.3 Export Control
The Services must not be used in violation of:
- EU export control regulations
- International sanctions and embargoes
- Anti-terrorism legislation

By using the Services, you confirm that:
- You have read and understood this AUP
- You agree to comply with all provisions of this AUP
- You have authority to bind your organization to this AUP
- You will ensure that all Users comply with this AUP
- You understand the consequences of violation
